AI Images and Usage Rights: What Teams Need to Document

Provenance, model terms and disclosure requirements vary by tool and jurisdiction. A simple internal record prevents most problems.

Generating an image is easy. Being able to explain where it came from two years later is the part teams forget.

What to record per asset

  • Tool and model version. Terms change between versions, sometimes retroactively for new generations.
  • Date of generation. Determines which terms applied.
  • Prompt. Your only evidence of intent if an output is challenged.
  • Human editing performed. Substantial editing can change the copyright position.
  • Usage context. Commercial, editorial or internal.

Questions with unclear answers

Whether purely AI-generated images attract copyright protection differs between jurisdictions, and several cases remain unresolved. Names, logos and recognisable people carry separate publicity and trademark considerations regardless of how the image was made.

Disclosure

Several platforms require labelling AI-generated media, and audience expectations are shifting independently of the rules. When in doubt, disclose — the cost of a label is far lower than the cost of a retraction.
